IMPORTANT OFFER TERMS AND CONDITIONS
Vessel covered. This offer submission process applies exclusively to the Aquador 250 HT bearing Hull Identification Number AUDA1111H324 (“Vessel”).
Submission does not constitute acceptance or a sale. Submitting this form is a request for PowerTime to consider your proposed purchase terms. Submission does not constitute acceptance by PowerTime, reserve the Vessel, or create any agreement or obligation to sell, purchase, or transfer the Vessel. An acknowledgment of receipt, automated confirmation, or discussion of your submission does not constitute acceptance.
Approval and discretion. All submissions are subject to PowerTime’s approval. PowerTime reserves the right, in its sole discretion, to reject any or all submissions, negotiate with any prospective purchaser, withdraw the Vessel from sale, or select a prospective purchaser at any time, including before the end of the show. PowerTime is not obligated to select the highest offer or any offer.
Purchase agreement and deposit required. If PowerTime selects your submission for further consideration, you must complete and sign a boat purchase agreement acceptable to PowerTime and provide a $10,000.00 deposit within the deadline specified by PowerTime. No binding sale agreement or reservation of the Vessel arises unless and until the purchase agreement has been signed by both the buyer and PowerTime’s authorized representative and the required deposit has been received in cleared funds. Selection of your submission or an invitation to complete a purchase agreement is not, by itself, acceptance of your offer.
Incomplete transactions. Until both the fully signed purchase agreement and required deposit are in place, PowerTime may discontinue negotiations, cancel any preliminary selection or approval, and consider or proceed with another purchaser. Once those requirements are satisfied, the parties’ rights and obligations, including deposit refundability, cancellation, and closing requirements, will be governed by the signed purchase agreement.
No notice or opportunity to match required. PowerTime has no obligation to notify previous submitters that their submissions were declined, that another purchaser was selected, or that the Vessel is no longer available. Submitting an offer does not create a right to match another offer, receive priority, or receive further notice.
